Licensing
It is a requirement in Queensland that all private investigators are licensed under the
Security Providers Act 1993. The definition of a private investigator under Section 6 of the Act is as follows:
“(1) A private investigator is a person who, for reward
- obtains and gives private information about another person, without the other person’s express consent; or
- carries out surveillance for obtaining private information about another person, without the other person’s express consent; or
- investigates the disappearance of a missing person.”

It is also a requirement in Queensland that all process servers/commercial agents are licensed. Currently, commercial agents are governed by the Property Agents & Motor Dealers Act 2000. Being licensed under the Act means that a Commercial Agent is permitted to undertake the activities outlined in section 339 of the Act. Section 339 provides as follows:
“(1) A commercial agent’s licence authorises the holder of the licence (commercial agent) to perform the following activities as an agent for others for reward:
- to find, or repossess, for a person any goods or chattels that the person is entitled to repossess under and Agreement;
- to collect, or request payment of, debts;
- to serve any writ, claim, application, summons or other process.”
